Mobitech Mechanics take the privacy of your information very seriously. We are committed to respecting your Personal Data. Our privacy policy below explains how we will collect and use the information you give us when making an enquiry  using the Website. We may vary this policy from time to time and this is our current version published on this site.

What information do we collect?
When making an enquiry you will be asked to submit personal information about yourself in order to receive or use services. The information will include: name,
email address, contact phone number and vehicle registration plate.
We do not collect or request Sensitive Personal Data from you such as credit card or bank details.
We collect and store vehicle registration numbers, booking and MOT details.
We do not engage with users aged 16 years and under
If you are 16 or under we cannot engage with you. If we find that we have received information from anyone aged 16 and under, we reserve the right to cancel all enquiries and remove all personal data that you have supplied.

How do we collect information from you?
We ask you for information about you when you use our platform, email or call us, or message us using WhatsApp or Facebook messenger. For example when you want to make an enquiry or make a booking over the garage website or when you make an enquiry, we will use your information to make contact with you to enable us to help with your enquiry.

We will use information collected when you make a booking with Mobitech:
• to ensure that the service you have asked for is correctly delivered and managed.
• to maintain your customer card on Techman where we have created one.
• to ask you to review the service you received. You are under no obligation to
respond to this invitation.
• to respond to any online chat request’s you make.
With your consent, we may use information collected:
• to contact you about our products and services that we think may be of interest to you with Mobitech Mechanics Ltd
• to provide you with reminders when your car’s next service or MOT is due.

 

Where do we store your data?
Your data will be stored and processed securely within the EU via GoDaddy services. Mobitech relies on Gaddy web services, as such we set up Advanced Email and domain protection, May 2024 though GoDaddy web services.
It’s unlikely to Mobitech knowledge to happen, but using Godaddy, Your data may also be transferred, stored or processed outside the EU; where this is the case, we will ensure to the best of our ability that the data is stored securely and in accordance with EU data protection principles, for example by using providers within the EU-US Privacy Shield programme.g

By submitting your information, you agree to this transfer, storing or processing.

Who Do We Share Your Personal Data With?
We will not sell, rent or lease your data to third parties.
When you make a booking or make an enquiry including but not restricted to the
entry of a registration number, our website will share this data and where required to make a
booking any personal information you have provided with Mobitech Mechanics Ltd. we use this data to form a booking card on our garage management software Techman powered by Webseller pro.

We may share your registration number with third parties to enable us to get vehicle part quotes. 

By submitting your registration number and any personal data to us, you consent to such transfers taking place. We may share your personal data with service providers, suppliers and sub-contractors working on our behalf for the purposes of completing tasks and providing services to you on our behalf.

Where we use third-party service providers or other suppliers we Rely on them to keep your data secure and have no control over this. They may use it for their own record keeping purposes, this is beyond our control.
We may transfer your personal information and car registration number to a third party as part of a sale of some or all of our business and assets to any third party, or if we are under a duty to disclose or share your personal data in order to comply with any legal obligation or to enforce or apply our terms of use or to protect the rights, property or safety of our customers. In such case, we will take steps to ensure that your privacy rights continue to be protected.
In any event where your personal data is shared with a third party, we shall do our best to notify any affected Customer that your personal data has been transferred to and for what purpose.

How Long Do We Keep Your Data?
When you make an enquiry or booking we retain your personal data until such time as you request we no longer should hold your personal data which we have collected from you, with your original request.

We will delete or anonymise your personal data if requested.

TERMS AND CONDITIONS

Please read all these Terms and Conditions.

As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these Terms and Conditions to make sure that they contain all that you want and nothing that you are not happy with. If you are not sure about anything, just phone us on 07894441317 .

Application

  1. These Terms and Conditions will apply to the purchase of the services and goods by you (the Customer or you).
  2. We are Mobitech Mechanics Ltd a company registered in England and Wales under number 10232229 whose registered office is at
    5th Floor Castlemead,, Lower Castle Street,, Bristol,, BS1 3AG with email address enquiry@mobitechmechanics.co.uk ; telephone number ( 07894441317) (the Supplier or us or we).
  3. These are the terms on which we sell all Services to you. By ordering any of the Services, you agree to be bound by these Terms and Conditions.

Interpretation

  1. Consumer means an individual acting for purposes which are wholly or mainly outside their trade, business, craft or profession;
  2. Contract means the legally-binding agreement between you and us for the supply of the Services;
  3. work Location means the customers premises or other location where the Services are to be supplied, as set out in the Order;
  4. Goods means any goods that we supply to you with the Services, of the number and description as set out in the Order;
  5. Order means the Customer's order for the Services from the Supplier as set out in the Customer's order or in the Customer's written acceptance of the Supplier's quotation;
  6. Services means the services, including any Goods, of the number and description set out in the Order.

Services

  1. The description of the Services is as set out in our website, or other form of advertisement. Any description is for illustrative purposes only and there may be small discrepancies in any Goods supplied.
  2. All Services are subject to availability.
  3. We can make changes to the Services which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.


Own part disclaimer Disclaimer/labour only

if you decide you’d like to supply your own part and Mobitech agree to a labour only contract you’ll be asked to read and sign a disclaimer. This disclaimer will be on the estimate we send you for the labour you’ll be asked to click a link to agree to the work. This also means you have read and are agreeing to the disclaimer. You will also be asked to sign a disclaimer prior to Work beginning your mechanic will provide you with this.

  1. By clicking the link on your estimate, you authorise Mobitech Mechanics to repair or replace parts. Whilst Mobitech is happy to quote you for LABOUR only and fit the parts you supply, please take note of the following.  
  2. Not all parts are made to the same quality and standards. As Mobitech has not sourced the parts for your vehicle I can not guarantee the quality, reliablity or history of any part that you have sorced yourself.  As such please be aware Mobitech mechanics Ltd and our mechanics will take no responsibility for these parts failing in any way during the fitting process, when fitted to your vehicle or after fitting has taken place. Mobitech mechanics Ltd will also not take any resposiblity for any knock on consequences of the part you purchased failing. You must except that this responsibility lays solely with  you as the purchaser of the parts. As such you have no warranty on this part with Mobitech mechanics Ltd, for any warranty information on your part please refer to the seller of the part and they should be able to help you with any warranty information you require.
  3. Mobitech reserves the right to inspect any part your have purchased before our mechanic starts working on your vehicle. If our mechanic believe the parts is to be of poor quality, they have the right to refuse fitting. Mobitech mechanics Ltd has a responsibility to both our customers and the general public safety, therefore It would be irresponsible for them to fit parts they had deemed to be of sub standard quality,  and potential dangers likley to cause damage to your vechicle. We will always look to explain our findings so you can make an informed decision how to proceed.
  4.  I agree that Mobitech Mechanics is not responsible for any loss/damage to my vehicle and loss of property caused by fire, theft, or any other cause beyond the control. At Mobitech Mechanics Ltd our automotive repair services include trouble shooting, maintenance, and repairs as considered necessary by our experienced technicians.
  5. We strive to accurately diagnose and address issues with your vehicle to the best of our ability. While we make every effort to provide high-quality repair services, we cannot guarantee that all issues with your vehicle will be fully resolved or that no further issues will arise. We shall not be liable for any damages, losses, or expenses incurred as a result of any defects or failures in the repair work performed, including but not limited to consequential damages or loss of use of the vehicle.
  6. We provide a limited warranty on parts and labour for a specified 3 month period following the completion of the repair work. This warranty covers defects in materials and workmanship under normal use and service.
  7.  However, it does not cover damage resulting from accidents, misuse, or neglect of the vehicle. It is the customer's responsibility to inform us of any pre-existing issues with the vehicle and to provide accurate information regarding the vehicle's history, maintenance, and usage. Failure to do so may affect our ability to diagnose and repair the vehicle effectively. This disclaimer does not affect any statutory rights that may apply under applicable consumer protection laws.
  8. Additionally, it does not limit or exclude any liability for death or personal injury resulting from our negligence or fraudulent misrepresentation. By signing this Automotive Repair Disclaimer, you understand and accept the matters written above.

Customer Responsibilities

  1. You must co-operate with us in all matters relating to the Services, provide us and our authorised employees and representatives with access to any premises under your control as required, provide us with all information required to perform the Services and obtain any necessary licences and consents (unless otherwise agreed).
  2. Failure to comply with the above is a Customer default which entitles us to suspend performance of the Services until you remedy it or if you fail to remedy it following our request, we can terminate the Contract with immediate effect on written notice to you.

Basis of Sale

  1. The description of the Services and any Goods in our website, or other form of advertisement does not constitute a contractual offer to sell the Services or Goods.
  2. When an request has been made, we can reject it for any reason, although we will try to tell you the reason without delay.
  3. A Contract will be formed for the Services ordered, only upon the Supplier sending an email to the Customer saying that the service has been accepted or, if earlier, the Supplier's delivery of the Services to the Customer.
  4. Any quotation or estimate of Fees (as defined below) is valid for a maximum period of 7 days from its date, unless we expressly withdraw it at an earlier time.
  5. No variation of the Contract, whether about description of the Services, Fees or otherwise, can be made after it has been entered into unless the variation is agreed by the Customer and Mobitech. This may be via email, text.
  6. We intend that these Terms and Conditions apply only to a Contract entered into by you as a Consumer where we, the Supplier and you the Customer, enter the Contract at the customers premises or a premises used by Mobitech Mechanics Ltd.

Fees and Payment

  1. The fees (Fees) for the Services, the price of any Goods (if not included in the Fees) and any additional delivery or other charges is that set out in our price list current at the date of the Order or such other price as we may agree in writing. Prices for Services may be calculated on a fixed fee or on a standard rate basis.
  2. Fees and charges include VAT at the rate applicable at the time of the Order.
  3. Payment for Services must be made within 7 days of invoice. You must pay by BACs or by your credit or debit card with you Mobitech on the day by card machine, we can take payment immediately or otherwise within 7 days of the delivery of the Services.

Delivery

25. We will deliver the Services, including any Goods, to the Delivery Location you have instructed us to, for the time agreed or, failing any other agreement:

  1. in the case of Services, within a reasonable time for agreeded booking; and
  2. in the case of Goods, without undue delay and, in any event, not more than 30 calender days from the day on which the Contract is entered into, unless otherwise aran and discussed with the customer.
  3. after we have failed to deliver on time, you have specified a later period which is appropriate to the circumstances and we have not delivered within that period.
  4. once delivery of goods has been made and fitting begun, if you then request to cancel the job, all goods received are/remain the property of Mobitech Mechanics Ltd until your bill has been paid, even if you request the service is not complete, you will still be liable for the agreed payment of the requested job.
  5. If any Goods are of a custom order made pacifically for your requested job and where Mobitech Mechanics Ltd have placed a none refundable order, the customer will continue to take responsibility for the final payment of that custom none refundable order.
  6. We do not offer goods or services or deliver to addresses outside England. 
  7. You agree we may deliver the Goods in instalments if our suppliers suffer a shortage of stock or other genuine and fair reason, subject to the above provisions and provided you are not liable for extra charges.
  8. The Goods will become your responsibility from the completion of services. You must, if reasonably practicable, examine the Goods before accepting them.

Risk and Title

  1. Risk of damage to, or loss of, any Goods will pass to you when the Goods are delivered to you.
  2. You do not own the Goods until we have received payment in full. If full payment is overdue or a step occurs towards your bankruptcy, we can choose, by notice to cancel any delivery and end any right to use the Goods still owned by you, in which case you must return them or allow us to collect them.

Withdrawal and Cancellation

  1. You can withdraw the Order by telling us before the Contract is made (you receive a booking confirmation via message or email) if you simply wish to change your mind and without giving us a reason, and without incurring any liability.
  2. You can cancel the Contract except for any Goods which are made to your special requirements by telling us no later than 3 calendar before you booking is due to take place. This does not affect your rights when the reason for the cancellation is any defective Goods or Services. Planning to cancel within free calendar days may incur a standard cancellation fee £55.

Conformity and Guarantee

  1. We have a legal duty to supply the Goods in conformity with the Contract, and will not have conformed if it does not meet the following obligation.
  2. Upon delivery, the Goods will:
  3. be of satisfactory quality;
  4. be reasonably fit for any particular purpose for which you buy the Goods which, before the Contract is made, you made known to us (unless you do not actually rely, or it is unreasonable for you to rely, on our skill and judgment) and be fit for any purpose held out by us or set out in the Contract; and
  5. conform to their description.
  6. It is not a failure to conform if the failure has its origin in your materials.
  7. We will supply the Services with reasonable skill and care.
  8. We will immediately, or within a reasonable time, give you the benefit of the free guarantee given by the manufacturer of the Goods. Details of the guarantee, including the name and address of the manufacturer, the duration and territorial scope of the guarantee, are set out in the manufacturer's guarantee provided with the Goods. This guarantee will take effect at the time the Goods are delivered, and will not reduce your legal rights.
  9. For manufacturer's guarantee provided with the Goods, please refer to the individual manufacturer’s guidanc.
  10. In relation to the Services, anything we say or write to you, or anything someone else says or writes to you on our behalf, about us or about the Services, is a term of the Contract (which we must comply with) if you take it into account when deciding to enter this Contract, or when making any decision about the Services after entering into this Contract. Anything you take into account is subject to anything that qualified it and was said or written to you by us or on behalf of us on the same occasion, and any change to it that has been expressly agreed between us (before entering this Contract or later).

Duration, Termination and Suspension

  1. The Contract continues as long as it takes us to perform the Services.
  2. Either you or we may terminate the Contract or suspend the Services at any time by a written notice of termination or suspension to the other if that other:
  3. commits a serious breach, or series of breaches resulting in a serious breach, of the Contract and the breach either cannot be fixed or is not fixed within 30 days of the written notice; or
  4. is subject to any step towards its bankruptey or liquidation.

47. On termination of the Contract for any reason, any of our respective remaining rights and liabilities will not be affected.


Privacy

  1. Your privacy is critical to us. We respect your privacy and do everything we can to keep your information safe.
  2. These Terms and Conditions should be read alongside, and are in addition to our policies, including our Privacy Policy and Cookies Policy which can be found Our privacy policies can be found On our website or attached to any of our invoices.
  3. For the purposes of these Terms and Conditions:
  4. Where you supply Personal Data to us so we can provide Services and Goods to you, and we Process that Personal Data in the course of providing the Services and Goods to you, we will comply with our obligations imposed by the Data Protection Laws:
  5. before or at the time of collecting Personal Data, we will identify the purposes for which information is being collected;
  6. we will only Process Personal Data for the purposes identified;
  7. we will respect your rights in relation to your Personal Data; and
  8. we will implement technical and organisational measures to ensure your Personal Data is secure.Duration, Termination and Suspension

  15. Successors and Our Sub-contractors


48. In the event of any failure by a party because of something beyond its reasonable control:

  1. the party will advise the other party as soon as reasonably practicable; and
  2. the party's obligations will be suspended so far as is reasonable, provided that that party will act reasonably, and the party will not be liable for any failure which it could not reasonably avoid, but this will not affect the Customer's above rights relating to delivery and the right to cancel.

Excluding Liability

        49. We do not exclude liability for: (i) any fraudulent act or omission; or (ii) death or personal       injury caused by negligence or breach of the Supplier's other legal obligations. Subject to this, we are not liable for (i) loss which was not reasonably foreseeable to both parties at the time when the Contract was made, or (il) loss (eg loss of profit) to your business, trade, craft or profession which would not be suffered by a Consumer - because we believe you are not buying the Services and Goods wholly or mainly for your business, trade, craft or profession.

Governing Law, Jurisdiction and Complaints

  1. The Contract (including any non-contractual matters) is governed by the law of England and Wales.
  2. Disputes can be submitted to the jurisdiction of the courts of England and Wales or, where the Customer lives in Scotland or Northern Ireland, in the courts of Scotland or Northern Ireland respectively.
  3. We try to avoid any dispute, so we deal with complaints as follows:
    If a customer is unsatisfied with the services we have provided they should contact us within 10 days of delivery so we can discuss potential solutions. All parts that are brought new will come with the standard uk consumer rights from the supplier of said part.
